Louisiana Gov. Jindal Passes Some Tax Credit, Other Legislation

BATON ROUGE In the waning days in which Governor Bobby Jindal has to sign legislation into law, today, Governor Bobby Jindal announced that he has signed the following bills passed by the legislature into law, bringing the total to 433 bills signed into law to date.   A number of these bills deal with tax credits, economic development districts and a full range of issues.  Many observers are waiting to see what the Governor will do regarding a number of the other tax credit programs passed by the legislature which they feel will help improve the economy and create industry.  Here is the list of legislation which are wide-ranging in nature, signed by Governor Jindal :

 

SB 9 – Sen. Long

This bill provides a state sales tax exemption for new boats, vessels, or other water craft used as demonstrators. The bill also defines what property can be declared “immovable” for the purposes of existing sales and use tax exemptions. In addition, the bill provides a sales tax exemption for the purchase of green railroad ties. 

 

SB 10 – Sen. Dupre

This bill allows the use of technology that makes enhanced oil recovery feasible.

 

SB 20 – Sen. Chaisson

This bill relates to the payment of health care premiums for district attorneys upon retirement.

 

SB 33 – Sen. Chaisson

This bill clarifies sales tax exemption for utilities businesses and also exempts sales of tangible personal property on installations or other property owned or operated by the Military Department from state and local sales tax.

 

SB 66 – Sen. Dupre

This bill relates to the North Lafourche Conservation, Levee and Drainage District.

 

SB 82 – Sen. LaFleur

This bill relates to the purchase and storage of commercially manufactured black powder.

 

SB 84 – Sen. Adley

This bill increases the advertising threshold for purchases of materials and supplies.

 

SB 95 – Sen. Martiny

This bill relates to secretaries of certain civil service boards in Jefferson Parish.

 

SB 102 – Sen. Duplessis

This bill relates to the East New Orleans Neighborhood Advisory Commission.

 

SB 103 – Sen. Duplessis

This bill creates and provides for the Oak Island Neighborhood Improvement District.

 

SB 104 – Sen. Duplessis

This bill relates to the Lakewood East Security and Neighborhood Improvement District.

 

SB 107 – Sen. Cheek

This bill provides for the Uniform Emergency Volunteer Health Practitioners Act.

 

SB 124 – Sen. L. Jackson

This bill expands the authority of the board of trustees of the Shreveport Police pension system.

 

SB 125 – Sen. Thompson

This bill provides for the payment of insurance premiums for retired sheriffs and deputy sheriffs in Madison Parish.

 

SB 137 – Sen. L. Jackson

This bill transfers the functions related to the licensure of child care facilities and agencies, other than daycare centers, from the office of the secretary of DSS to the office of community services within the DSS.

 

SB 143 – Sen. Amedee

This bill provides for the use of electronic applications for warrants and signatures.

 

SB 147 – Sen. Murray

This bill amends the historic rehabilitation credit to allow the credit to be transferred a total of 3 times, instead of the 2 times currently allowed by law.

 

SB 150 – Sen. Murray

This bill relates to parcel fees on parcels located within the Lakeview Crime Prevention District.

 

SB 160 – Sen. Marionneaux

This bill provides that unless otherwise provided by the statute creating the tax credit, all tax credits that have an annual cap or total program cap will be issued on a first come first serve basis. 

 

SB 163 – Sen. Marionneaux

This bill clairfies that in order to receive an income tax deduction for school expenses, the child must be qualified as a dependent on the taxpayer’s Louisiana income tax return.

 

SB 175 – Sen. Michot

This bill relates to the membership, jurisdiction and authority of the La. Motor Vehicle Commission and the La. Used Motor Vehicle Commission, and for the distribution and sale of motor vehicles and recreational products.

 

SB 193 – Sen. Long

This bill repeals the homeowner policy premium assistance program.

 

SB 235 – Sen. N. Gautreaux

This bill provides for the appointment of the chief of police in the town of Duson.

 

SB 239 – Sen. Dupre

This bill creates a requirement that commercial fishermen operating in the freshwater areas of the State obtain a commercial vessel license in order to obtain the tax exemption provided for commercial fishermen from state sales, use, lease and services taxes.

 

SB 241 – Sen. Mount

This bill provides for an income tax check-off donation for National Lung Cancer Partnership.

 

SB 252 – Sen. Walsworth

This bill provides refundable tax credits of 5% of qualified expenditures for a modernization project.

 

SB 262 – Sen. Martiny

This bill relates to commissioners of local housing authorities.

 

SB 287 – Sen. Martiny

This bill authorizes a musical and theatrical production income tax credit for limited state-certified musical or theatrical productions.

 

SB 313 – Sen. McPherson

This bill relates to motor vehicle fatalities.

 

SB 320 – Sen. Alario

This bill relates to the organization of the executive branch of state government.

 

SB 339 – Sen. Marionneaux

This bill extends the length of time that participants in the Louisiana Capital Companies Tax Credit Program have in placing qualified investments.

 

HB 5 – Rep. Guinn

This bill exempts crawfish bait and feed from state sales tax.

 

HB 9 – Rep. Baldone

This bill excludes certain nonprofit homeless shelters from state and local sales tax.

 

HB 14 – Rep. Burford

This bill relates to insurance for the Desoto Parish Sheriffs Office.

 

HB 66 – Rep. Guinn

This bill repeals the continuing education requirement for licensed auctioneers.

 

HB 106 – Rep. Greene

This bill exempts from state individual income taxation net capital gains (income taxed at the federal capital gains rate) arising from the sale of a non-publicly traded business located in Louisiana.

 

HB 112 – Rep. Montoucet

This bill relates to the membership of the Teachers’ Retirement System of Louisiana.

 

HB 218 – Rep. Hardy

This bill requires regular inspections of fire safety and prevention equipment at public elementary and secondary schools.

 

HB 223 – Rep. Armes

This bill relates to noncomplex health procedures performed by certain school employees.

 

HB 246 – Rep. McVea

This bill relates to the issuance of bonds and provides an increase in the debt limit of a school board for specified purposes.

 

HB 307 – Rep. Greene

This bill is companion legislation to a proposed Constitutional amendment that would clarify that the quantity or size of food sold for home consumption would have no bearing on its sales tax exemption status.

 

HB 320 – Rep. Gallot

This bill provides that the manufacturing and machinery statutory exemption from sales tax be expanded to include the manufacturing of glass containers.

 

HB 338 – Rep. Greene

This bill clarifies provisions within the School Tuition/Expense Tax Deduction Law.

 

HB 367 – Rep. Dove

This bill relates to the position of police chief in the city of Houma.

 

HB 390 – Rep. Henderson

This bill permits DHH to grant exemptions from certain National Shellfish Sanitation Program management plans.

 

HB402 – Rep. T. Burns

This bill relates to the position of police chief in the cities of Mandeville and Houma.

 

HB 406 – Rep. Pearson

This bill places Louisiana in compliance with the federal Genetic Information and Nondiscrimination Act of 2008, provides technical corrections to mandated autism coverage and relates to Medicaid and private health insurer coverage for certain providers of health services for catastrophically ill children.

 

HB 473 – Rep. Little

This bill creates a state and local sales and use tax exemption for polyroll tubing sold or used for commercial farm irrigation.

 

HB 528 – Rep. Chandler

This bill creates an economic development district in LaSalle Parish.

 

HB 535 – Rep. P. Williams

This bill establishes a statewide council within the Health Works Commission overseeing the coordination of resources involving certain medical simulation training centers.

 

HB 540 – Rep. B. Badon

This bill relates to the Firefighters’ Retirement System.

 

HB 582 – Rep. Burrell

This bill changes the boundaries of the Shreveport Downtown Development District.

 

HB 593 – Rep. Billiott

This bill authorizes political subdivisions to invest in bonds, debentures, or notes issued by the State of Louisiana or any of its political subdivisions.

 

HB 604 – Rep. Aubert

This bill relates to surplus property of a police jury.

 

HB 620 – Rep. Cortez

This bill makes modifications to the Medical Assistance program Integrity Law.

 

HB 629 – Rep. Landry

This bill relates to temporary restraining orders for domestic abuse cases.

 

HB 670 – Rep. Ernst

This bill clarifies the disposition of land procedures for the Louisiana Land Trust.

 

HB 687 – Rep. Pearson

This bill directs the Louisiana State Board of Dentistry to adopt rules related to delivery of dental services outside a dental office.

 

HB 695 – Rep. Greene

This bill relates to gubernatorial transitions and inaugurations.

 

HB 696 – Rep. Barrow

This bill changes the boundaries of the Greenwell Springs-Airline Economic Development District.

 

HB 719 – Rep. Chaney

This bill authorizes multi-year contracts for professional, personal, consulting or social services and changes the maximum length of those contracts from three to five years. This bill authorizes the state’s lease with the New Orleans Saints.

 

HB 734 – Rep. Carter

This bill authorizes a state sales and use tax exemption for purchases made by qualifying radiation therapy treatment centers.

 

HB 753 – Rep. Richmond

This bill increases the credit cap for a single business under the New Markets Tax Credit Program.

 

HB 756 – Rep. Montoucet

This bill requires certification for eligibility for the manufacturing machinery and equipment exclusion at the point of sale for farm equipment. The bill also contains a sales tax exemption for the Cajundome and a sales tax exemption for construction materials used for renovated Hands on New Orleans homes and newly constructed Fuller Center-built homes.

 

HB 798 – Rep. Carter

This bill relates to marketing for state-certified productions and state-certified musical and theatrical infrastructure projects.

 

HB 801 – Rep. Simon

This bill relates to restrictions on bids or proposals for public contracts by Architects, Engineers and Contractors.

 

HB 806 – Rep. Katz

This bill relates to background checks by the Board of Nursing Facility Administrators.

 

HB 818 – Rep. Ellington

This bill authorizes an exclusion from state sales and use taxes for certain tangible property related to the manufacturing process, including fuses, belts, felts, wires, conveyor belts, lubricants and motor oils.

 

HB 820 – Rep. M. Guillory

This bill provides for improved tracking of dismantled or salvaged vehicles.

 

HB 827 – Rep. Simon

This bill makes revisions to the election code for voters with special needs.

 

HB 829 – Rep. Cortez

This bill transfers responsibilities relating to water wells and drillers from DOTD to DNR.

 

HB 858 – Rep. Ponti

This bill expands eligibility for the wind and solar energy system tax credit to taxpayers who purchase and install such systems in residential properties.

 

HB 859 – Rep. St. Germain

This bill grants authority to East Baton Rouge Parish to name a bridge.

 

HB 868 – Rep. Little

This bill provides relative to the collection of timber severance taxes and authorizes the commissioner of the Department of Agriculture to appoint a director under certain circumstances.

 

HB 864 – Rep. Richmond

This bill provides for the assessment and allocation of certain fees for law enforcement training.

 

HB 869 – Rep. Tucker

This bill provides for the expenses of the legislature and legislative service agencies.

 

HB 885 – Rep. Perry

This bill relates to the distribution of revenues collected by the Vermilion Parish Tourist Commission.
